Quick Summary
The Bar Council of India (BCI) has issued a notification proposing that all judicial service aspirants must first practice at the bar for a minimum of three years. The BCI believes this experience is crucial for judicial officers to effectively handle cases and interact with legal professionals and litigants. They are seeking to make this a mandatory requirement, even moving the Supreme Court to be included in a case challenging this rule.

• The BCI has issued a notification dated 02/01/2021, conveying its preference to have judicial services aspirants to practice at bar for 3 years.

• As per the notification, the Judicial Officers who appointed without prior experience at bar are incapable of handling matters and dealing with members of Bar & litigants.

•  It suggests that requiring a minimum of 3 year’s experience at Bar would increase their efficiency and lead to faster disposing of cases.

•  The BCI condemned the 2002 All India Judges Asso. V. UOI wherein the Supreme Court had done away with the requirement of 3 year’s practice.

• The BCI has moved an application to be impleaded as a party in the writ petition filed against Andhra Pradesh Judicial Services.
