Factual Background

  • The name of the case is Shivsagar Yadav v. State of UP.
  • The victim girl was travelling in a bus when the accused and some unknown persons had forcibly taken the victim off the bus.
  • They took her to an unknown destination where she was sexually assaulted and looted. She was further raped one by one and threatened to not share the incident.
  • She approached the police who raided the place and found the accused intoxicated and naked.
  • The accused was an acquaintance of the victim and had sexually assaulted her and taken her obscene videos previously through which she was blackmailed repeatedly.

Single Bench

  • The Court found evidence of physical violence and burn marks by cigarette on the victim from the medical report.
  • The FSL examination showed that she was subjected to brutal and merciless sexual assault.
  • There is no evidence that she had committed to a consensual relation with the accused and it wasn’t a case of false implication or mistaken identity.

Court’s Orders

  • An accused in the Jhunsi Gang Rape case of 2019 was denied bail by the Allahabad High Court citing that he deserves no sympathy.
  • He had taken ill advantage of his masculinity to overpower and butcher the physical body of the poor victim.
  • It is the most inhuman and abhorring offence committed by the accused.
  • The Trial Court was asked to decide the expeditiously.
