My Wife filed a 498a case against me after a stay of 30days with me and i filed for RCR after that and she filed a counter for not will to join back with me along with the Maintanance case.She attended for few days to court ,though she is working and now a days she is not attending from past 4 times and again she attended once.Now she again started not attending the court.
And the court is giving very long dates for further sessions.This has been 4th time i guess court called as for ENQUIRY....
It has been dragging from past 1.5 yrs and not sure why court is not any action when she is not attending and irregular to the court for her maintainance petition/for my RCR petition?
My questions are:
1.How long the RCR/maintainance case will take for judgement?
2.What will happen if she is not attending the case?
3.Is it good to file a petition for faster judgement?Or to wait till cout takes an action?
4.What is Exparty ,When it is applicable ?Will court invokes this Exparty or we need to do this?
5.My Wife and her parents filed for maintainance just to harass me ,though she is working and earning handsome salary...Iam fed up in attending the court with no action.It's a mental trauma for me everytime to attend the court for these cases from past 2yrs...Can i file a case against them for misusing the law though she is working ?Please suggest me....
