Would appreciate your kind help in having varas nond been done for a property land in Mumbai andheri (e).
The property is on my grand fathers name who passed away in 2008. He had 3 children as below.
1. My father
2. Aunt 1 - Who has physical possession of land.
3. Aunt 2 - Married and Settled in US since past 30-40 years.
My father applied for varas non to be done for all the 3 children in andheri city survey office along with all required proofs attached.
After a months time we got a reply that due to the land having 'satta prakar' we need to provide 'bin sheti' certificate for having the varas non been done.
I have consulted a lawyer and he said that for varas nond to be done there is no need to provide bin sheti certificate as we are not willing to sale or rent the property by only add varas non i.e legal hair names to be added. He said we can make a appeal to higher authority stating a wrong reply is been received from the city survey officer.
Would appreciate your kind opinion on this matter.
