Vacation of Premises during the Lock In Period

A premises is taken on lease for a period of 2 years, by means of a registered lease agreement, where the entire 2 years period is the lock in period, i.e. the lessee shall have to pay the rent of the entire period even if he vacates during the lock in period (This condition is clearly written in the registered lease agreement)

 

The lessee gives a notice under Section 106 & Section 111 of the TPA and hands over the premises to the lesser.

 

My Queries are

1.   Does taking possession by the lesser during the lockin period, jeopardize the right of the lesser to recover the rent of the lock in period

2.   Is the notice by the lessee under Section 106 of the TPA valid when there is a registered written contract specifying the terms of the lease
