Undivided Hindu Property

My grandfather owns a self earned property. He passed away 30 years ago without a will. He has 2 Sons. My grandfather's wife(my grandmother) also passed away 5 years ago. The property so far has never been divided and we all live together in it. My father has 2 sons who intern have 2 sons each(minor). My fathers brother also has 2 sons(both are unmarried).


1. How will the property be divided right now if we decide to split. Who will all be entitled for a share and what percentage.

2. Are we classfied as a Hindu Undivided Family and are we entitiled to follow HUF laws.

3. Do myself and my kids have a share from my grandfather's property. If we want to amicably divide how will the property be divided by HUF.

Your father and his brother will get 1/2 share each in the properties of your grand father. Then in your father's share you will get 1/4 th share and so on your uncle's sons.

1/4th  = your father + your Mother + yourself + Your brother
