Suit for return of dishounoured cheque is maintainable

i intend to file a suit for return of dishounered cheque on the ground that the said cheques so issued were admittedly security cheques and does not carry consideration. the holder of cheque had already instituted 138 of N.I. Act case against my client. pls give your comment whether such suit will be mainatainable or wil be hit by section 41 of specific relief act. Then what is the alternate remedy get the cheque back
