Succession certificate query

My father has passed away and he didnt create a will. My mother and myself are the only legal heirs and i am the only child. My father has a joint property in Kolkata along with his brothers. Now everyone wants to sell the property. Do i need a succession certifcate in order to sell the property. Thanks for your advice n help.

As the property is joint family property, you can execute the sale deed as legal heir of your father, with your mother and you can simply obtain a legal heir certificate from local authority at the place where your father breathed last.  What the seller wanted is possession and signatures of legal heirs of the property.  (Everyone wanted to sell the property is considered all legal heirs including your father's brothers)
