Stay validity

Dear Sirs,

In an appeal in Sessions court under section 29 of DV Act a conditional stay has been granted to the Appellant. The query is whether the stay is valid till the disposal of the case by Sessions Judge or is it time bound?

This stay will be there tlll some more proofs challenging this stay are produces by the opp party to challenge this stay.

 

For Example:- Somnath Bharti's wife Lipika Mitra complained about Domestic Violence. Somnath Bharti is just saying that he has no relations with lipika for past 5 years. Now if court grants stay then lipika will have to produce proofs that they did had relations. (Relations बोले तो  DOMESTICITY i.e., living together & NOT just email proofs)

 

Now respected lipika ji might have to prove that there indeed was any domestic relationship between the two in order to be charged with DV Act'2005
