Secion 2 (b) Right to Education Act 2009: clarification.

Section 2 (b) of the Right to Education Act 2009, "capitation fee" means ............... other than the fee notified by the School. Does it mean that the School can notified fees for the students eg; Rs.300/- or Rs.350/- from the students as capitation fees? If no, does such collection from the students as capitation fees amounts to criminal offence? Is there any penalty prescribed for such collection of fees from the students?
