Sales deed execution after sales agreement.

Hi Sirs/ Madam,

We have planned to buy a agriculture land, the lands sales agreement is done already. The land belongs to a person Mr. X and his brother Mr. Y, Y is dead already now the property belongs to X and Y's wife. During execution of sales agreement consent of witness included for the children's of sisters of X and Y, who are no longer alive (May be there age around 80, but no longer alive). As the property is ancestral property, we were worried if and included X, Y sister's children as consent of witness. But my question is the consent of witness mentioned above need to be present during registration at sub registered office? please clarify.

No, ancestral property be cannot be sold without consent of successors in case of major and in in case of minority you might have to take permission from the court. And if property disposed without consent can be reclaimed.
