sale of property under sarfaesi act

D/A , I want available remdies for a bidder who is participated in a bid . He already paid 10 % but could not pay 15 % immediately after completion of bid . He was a single bidder . He approched the bank after 3-4 days and now bank is saying that his 10 % shall be forfieted . The bank or auction agency did not commincated this mandatory required in writing to the bidder . Is there any process to take refund from the bank or to continue in the process of buying through bid . Pls advise  


make a representation to the bank & file a writ petition before high court for refunding ..
