Salary issue

Myself Rajeev saini, I have salary issue with my company. Actually i worked for an web design & Online marketing company name Tech Dk located Laxminagar, Delhi. I joined this company in January 2017 as SEO Specialist and worked for two month for the company but this company have not provided me any appointment letter  at the time of joining, I asked it for so many times but they have not provided me but they  given me salary of January month but they have not provided me the salary of February  i.e my second Month, currently I resigned from the company and completed my notice period but they have not given my salary I asked them so many times on phone and I also went to office to collect my salary  but they always procrastinate they have not received payments from their clients so they are unable to given salary. Please advise me what I should do to get my salary. I have only an Email id by which I communicate in company and my boss number I.e 09810734737 and the first month salary check number and account statement of bank as a proof that I worked for a company.

Discuss your isses with elders of your family and keep them by your side while you agitate.

They can guide and help you at each step.

You may approach:

IT/ITeS employees' unions ( There are many and embraced by trade unions)

Trade Unions e.g; BMS,CITU,INTIC, AITUC etc etc ( Each must be having office in Delhi)

A very able counsel specializng in Labor/Service matters

 

If you are unable to resolve on your own.

You can approach:

 

Inspector appointed under: 

Delhi Shops & Estbs Act ( Discuss Issuance of appointment letter, wage slip, payment of wages, Notice period in your case may be NIL and also since earned wages were not paid employer is unworthy to be employed with and such clauses should loose the sanctity)

Payment of wages Act ( If you are covered by the def. of wages as in the Act.This Act does not discriminate between workma, /Non workman)

Thanks for your message

Sir my monthly salary is 20,000, I come to know salary more than 15000 thousand not comes under labour commissioner, is it true, if true then in such cases where salary more than 15000 as of my 20000 where one can apply for resolve the issue, please sir suggest.

1. Salary, designation alone does not decide employee is covered by the def. of workman and in ID Act or not.

2. A person that is not covered as Workman but covered by the def. of ‘Employee’ as in Shops & Estbs Act can approach Inspector appointed under the Act.

Payment of wages Act ( If you are covered by the def. of wages as in the Act.This Act does not discriminate between workma, /Non workman)

Check  with local counsel specializing in Labor/Service matters.
