Road Encroachment

hi all,

We live in a very small dead ended street, and ours is the last house. However, people who live at the beginning of the street, has encroached the street and have extended their house compounds to the street. We requested not to, but that doesnt work. And they also say they have the local governments support and say do watever we wish to do and that wouldnt work out.

I want to go legally and file a petition. Can anyone please help me out the procedure to file a petition and resolve this issue and get a space for all those in the street.

1. File a complaint with the ward officer about the encroachment alongwith relevant details. Make sure you get some kind of acknowledgement. Once you do, follow it up. If you do not get a response, file an RTI to get the progress of the complaint.

2. Using RTI, find out the plan (like widdth of the road etc) for your colony/neighbourhood. This is a paid service and you will need to know your CTS no. Once you do, point out the discrepancies to the  municipal authorities and follow it up consistently.

All this is useful if you can show that their actions are causing some damages to you or your property. The idea is to keep the pressure going through complaints and information found using RTI. Since these are home owners, there is a possibility that there might be some action atleast.

U file a civil suit against all these member, u contect local lawyer for that . U attech these document (1) Plan Pass Copy of the Scheme / Building / Flat / Bungalow / Premises etc... (2) Building Use Permission of government authority (3) N.A Permission (4) Photograph of the illegal properties.
