Resident owner refusing his share of apartment painting costs

Hello Respected Sirs/ Madams,
I live in an apartment which is having a Resident welfare association registered under the society act. The apartment is more than 10 years old and hence the association decided to paint the outer building after approval from the Executive committee. All the owners excepting one have paid their share towards the painting costs. One resident Owner alone is refusing to pay his share as he claims he did not recieve support from association when there was a water leakage problem from the flat above his one. However he is paying the maintenance charges properly. Now that all the others having paid the painting costs, it would be injustice to let this owner alone off without paying his charges. Pls advice on how to recover the same from him by legal means as talks with him till date have failed to bear fruit
