I am trying to purchase a flat on resale. It is a 1 BHK, with a private terrace attached area equal to the 1 BHK flat area. The 1 BHK flat agreement mentions only 383 sq. ft. as carpet area, 56.94 sq. ft. for the balcony within the house, and the terrace is only mentioned. On the blue-print, however, the terrace is clearly shown as belonging to the house, and is equivalent in size to the flat. There are many such flats in the society with similar feature, all on the top floor of the buildings. Is there any way to register the complete area, including the terrace, in the new agreement? On what basis should I be paying for the flat? The owner is asking as per the prevalent rate, but for the complete area including the terrace. What happens in case the building goes for reconstruction, since it is an old building? Will I get the complete area, or only the carpet area mentioned? The said property is in Thane, Maharashtra.
