Reliving letter issue

Page no : 2

Kumar Doab (FIN)     02 June 2017

Go thru:

Gujarat Shops & Estbs Act

Gujarat Shops & Estbs Rules

Gujarat followed earlier Bombay Shops & Estbs Act.

The Act and RUles framed under it may have many registers that are for each employee and have crucial details like:

DOJ-LWD.

e.g; FormN,T in  Tamilnadu Shops & Estbs Act

Gujarat Shops & Estbs Act and Rules may have provision for service certificate.

Relieving letter signifies that employee has separated and nothing is due towards employee.

1st of all apply your skills and resolve the matter.

Build irrefutable written record and proper acknowledgtment.

Remain amiable and gentle.

Kumar Doab (FIN)     02 June 2017

Approach:

Employee's/Trade Unions and they can help and support you

A very able senior Local counsel of unshakable repute and integrity specializing in Labor/service matters. Employee's/Trade Unions are also aware of such counsels.

You can also inquire at Labor court/CGIT,Civil Courts,CAT,HC,

Kumar Doab (FIN)     02 June 2017

Your counsels may opine to approach:

Inspector appointed under: Gujarat Shops and Establishments Act,

O/o Labor commissioner (State/Central) as applicable in your case. It seems that it shall be State in your case.

Civil Courts

I am sending few links to you.

You may pick relevant points to your matter and use.

So is my case strong?
Ya as per your advice I will go to labour commissioner and trade union leader, if on worse come worse basis If I decide to file a case against my proprietor (this is the last option i will prefer) than what can be the outcome??
will it be viable to go for that option ?? If I file case how much time courts generally takes to solve such matters? I am bit worried abour sluggishness of Indian courts to give verdict it is possible that this is my misinterpretation regarding indian court.

or should I keep sending request emails asking for reliving letter which will build written record as you said.

Discuss with elders, well wishers, unions, counsels.

You will get clarity.

Try to get copy of register under Shops &Estbs Act/Rules that is equivalent of Service certificate/Releiving letter....................

The matter may get resolved by Inspector also................

The time taken in court, merits, be inquired from local counsels.

Kumar Doab (FIN)     02 June 2017

Also try to get copy of reference check,BGV if any done in your case.

Aditya   02 June 2017

sir can you please eleborate more about copy of register under Shops &Estbs Act/Rules that is equivalent of Service certificate/Releiving letter and copy of reference check

as per my information its the employer who need to register under shops and estblishment act... how would it serve as a reliving letter...Not able to understand about that...

Kumar Doab (FIN)     02 June 2017

While Shops &Estbs Act can be searched by internet and/or on website of Dept. of Labor of State, the Shops &Estbs Rules may not be available.

Either get a copy from Dept. of labor or buy from market or get from Unions or from local counsel.
