Release deed dispute

Hi ,

I have filed a partition suit against 15 members of my family. 5 female members of the family had signed a release deed in the year 2005. The release deed are all registered. However their names are still on the 7/12 extract of the properties in dispute.Since their names are still on record I had made them a party to the dispute. Now they have all come back and demanding their share in property. Please advise if they still can claim their share inspite of signing release deed.

Thanks Dipen Yadav

Sir,

Apparently you had not applied to the authorities to remove the names after the release deed. It is the duty of the purchaser/owner to apply and request the transfer/removal of names in 7/12 extract. However, If the release deed is legally executed and registered, the signatories can not claim share.

Good Luck
