Flat with Joint name - Father & Aunty

Father Died
So I sublime death certificate & other documents to society to add my name in my father name.

Now Me & Aunty joint name added in share certificate.

Now I want to sell...

The buyer party said that you have to make release deed & registration.

my question is release deed is required ?
registration is required ?

Ji,  you are a nominee only that means you have no full  right over your late father's share.  is your mother alive? have you siblings?  if your mother is alive and having siblings, you have a equal right with them.  If your aunty relinquishes her share to you (you, your mother and your siblings) then you all can sell the property.


Yes, Mother & Sister is available. They give me NOC for transfer my name instead of my father & all authority..

My name is now added in share certificate with my aunty..

Now I want to sell..

But the buyer said that make release deed...

A nominee can not sell the flat. If the flat is situated in Chennai, Kolkata or Mumbai, succession certificate from High Court is necessary to be able to sell the flat.
