we got the cheque for Aus dollor 33000 which 100% advance for the shipment. we deposit the chequw and on 21/06/12 and our account cr. on 6th july with money- and we started the production... but on 13th july bank Dr. the same amount without our consent and knowledge . with REFER TO DRAWER reson.
and i came to know that this REFER TO DRAWER clause has been cancelled by RBI - 2yr ago?
can we take a legal action?

As per Banking Custom, it means that the cheque has been returned for want of funds in the account of the drawer.

Cheque return is ok- but when a fund come in account which i can withdraw has been dr. in 7-8 days..... is not return i think
