Reduction in Pay on account of subsequent new provision


 I joined central Govt.on 22.02.2007 from P.S.U(Nationalized Bank). My basic pay was fixed at Rs. 8125/-( 5500-175-9000) at par with my basic pay of Rs.13220/- of P.S.U. , as I was considred at par with the Govt. Servant drawing Rs8125/- as basic pay. Accordingly I was given correspoding pay fixation in the 6th pay Commission Scales i.e - Rs.15120/ Pay +4200/- Grade Pay in the table.
 

Now I am given to understand by my department that  Govt  of India has introduced a  new  office me morandum  No- 12/3/2009-Pay-I dated  30.03.2010 vide which a new formula of Pay Fixation was introduced in respect of Employee who joined Central Govt from P.S.U on or after 01.01.2006.

On the  basis  of this OM   my Pay(which was drawing till 29.03.2006 )was reduced from  Rs15120/-to    Rs11420/-     whether Pay of a Govt. Servant can be reduced on account of a subsequent order/introduction of a provision.

As i am facing a great financil loss please guide me as to

You are entitled for pay protection. If such is the case , the authority competent is to ensure that the employee's pay is not reduced consequent of new fixation.

I fully endorse the view of my brother colleague Mr. Gabriel. Although the employees canbe differentiated while granting monetary benefits by virtue of some special enactment but the wages can not be reduced except by way of punsihment. I would recommend challenging the vires of the said OM.

You are entitiled for pay protection as per your salary in PSU from the date of joining in Central Govt. I am enclosing new memorandum  :- No. 12/3/2009-Pay-I30/03/2010  dated 3oth March. 2010 - Guidelines for fixation of pay of candidates working in Public Sector Undertakings etc., recommended for appointment by the Commission by the method of recruitment by selection.

You may please go through it, And put up your case accordingly by giving this refernce to your deptt head..
