Recovery suit

Dear members,

please guide what is procedure of filing civil suit for recovery of money.

1. under which section such recovery suit can be file

2. jurisdiction of court

3. procedure of court in recovery suit

4.execution of decree

5.recovery etc.

before tiling the suit you will have to issue legal notice to claim the cost .  Limitation to file suit for recovery of money is three years.

you will have to file a suit u/o vii r 1 c.p.c.  and have to pay court fee on the claimed amount.

jurisdiction lies where the plaintiff resides or where the transaction takes place.

After the decree you will have to file exeuction petition to recover the decreetald amount.  You can also get atttached the moveables of the JD, if no moveable then you can get attach the immoveables of the Judgement debtor.

Dear Sam,

Recovery of money suits are governed under Order VII of CPC. 3 years limitation period.

.Either you refer CPC,1908 or go to forum section and select Civil forum.

Procedure of court in suit for foreclosure by the bank ,and if the defendent like to take some time to repay the loan amount .
