There is no provision for payment of a full salary with allowance to an employee of the Govt.(state or centra) if he dies while in service, accept family pension to his wife/husband.. But there is a provision for appointment of one of his family member under the compassionate ground in.

THEN THE ABNL SAID I NEED TO GET A COURT ORDER -- BUT I DONT FROM WHICH COURT - FROM PUNJAB ( WHERE HE OR ME DID NOT STAY FROM 20 YRS) OR MUMBAI WHERE HE DID NOT WORK

you need to get a succesion certificate which is provide by the District Judge. you need to go to a local advocate and consult with him process is simple you file case for succesion and notice will be published in newspaper for every1 who has any interest in that property can claim it, if no1 claims it goes to you legally. and you can give that certificate to bank and receive the sum.

Thanks for the answer , Raviji. Just one more query - Can any Civil advocate  help do this ? and should i go district court in Mumbai or Punjab

you can always take help of an Advocate and as for Mumbai and Punjab is concerned it depends upon if you are looking for immovable property(land etc.) othewise (money, succession, custody etc) at usual place of living.
