Dear M.Piravi Perumal,

I am a lawyer from Chennai. I think it is no harm in having this poll.

Though there is no second thought in having sympathy for the tamils in Srilanka, I feel that the lawyers fraternity should not boycott courts indefinetly for such causes. There are lakhs of cases pending in the courts for disposal and when such being the case we as lawyers have a duty to protect the interest of our clients.

As a matter of fact, I feel that majority of the lawyers are against boycott and want to attend courts. We can always show our solidarity by holding meetings after the court hours for this issue.

There are about 21 Tamil MPs in Sri Lankan Parliament and none of them have resigned for this issue. It is also a matter of fact we appreciate and praise Muthiah Muralitharan for his role in Sri Lankan cricket. He has not refrained himself from playing for Sri Lanka.

But in Tamilnadu, some of our politicians are making this as an issue. Why?

Sri Lankan issue is a political issue and lawyers are not politicians.

Only a section of the lawyers have taken up this issue and calling the shots.

I would only say no boycott. If anybody wants to protest for the Tamil cause, let his have a black badge and attend courts.

BCI condemns attack on lawyers:

New Delhi: The Bar Council of India (BCI) at an emergency meeting on Sunday, condemned the “dastardly” attack by the police on advocates, litigants and staff of the Madras High Court, including a High Court Judge, inside the court premises on February 19. It demanded a judicial enquiry into the incident.

The meeting said, “Such an attack is an attack on the judicial system of the country which must be condemned by one and all. Considering the gravity of the incident, the Council deems it appropriate to make an appeal to the members of the legal fraternity of the country to observe February 27 as a ‘black day/protest day’ in condemnation of such brutal attack by police on the judicial system.”

It said the State Bar Councils, High Court and District Bar Associations would decide the mode and the manner in which the ‘black day/protest day’ was to be observed in a peaceful and democratic manner.

The meeting resolved to send a committee comprising S.N.P. Sinha, Chairman, BCI, and Members, Milan Kumar Dey, S. Gopakumaran Nair, Ashok Parija and M. Jagdeesh to Chennai to take stock of the situation and to conduct a detailed inquiry into the incident. The Committee would meet the Chief Justice of the Madras High Court, Chairman of the State Bar Council and leaders of the bar associations.

It would also meet the Chief Minister and the Home Minister and demand that the police officials who were responsible for the attack be suitably punished. The Committee would also endeavour to bring about normality in the court premises to make the atmosphere conducive for normal functioning of the courts in the State.

The meeting requested the Chief Justice of the High Court to order a judicial probe by a retired High Court/Supreme Court judge to bring the guilty to book.

The BCI offered a sum of Rs.1 lakh to the Bar Council of Tamil Nadu as a token of solidarity with the members of the legal profession who were injured in the attack, to meet a part of their medical expenses.

CHENNAI: The Madras High Court Advocates Association (MHAA) has resolved to continue its indefinite strike.

In a resolution passed unanimously at an extraordinary general body meeting held at the Bar Council of Tamil Nadu meeting hall on Sunday, the association decided to “abstain indefinitely from all courts, tribunals and forums.” It wanted the gates of all courts in the State to be opened immediately and Central forces sent to provide the courts with security.

The Association demanded that the Director General of Police and the Commissioner of Police for Chennai removed immediately.

It called for immediate registration of First Information Reports against, and the arrest, of Joint Commissioner Ramasubramanian and other subordinate officers involved in the clash with lawyers on the High Court premises on February 19.

It also decided to file individual complaints against the police by the affected lawyers and on its own. It requested all advocates, including public prosecutors and government pleaders, not to appear on behalf of police personnel in the case.

The Association wanted a judicial commission enquiry, led by a sitting High Court judge, into the incidents of February 19. It also resolved to organise a nationwide protest against what it called the attack on the judiciary.

A State-level committee has been formed to coordinate further action. Among the members are MHAA president R.C. Paul Kanagaraj; Bar Council of Tamil Nadu chairman R. Chandramohan; Bar Council of India member R. Dhanapalraj; Bar Association president R. Krishnamoorthy; Tamil Nadu Bar Federation president Paramasivam; and representatives from the Madurai, Tirunelveli and Coimbatore Bar Associations.

The sight of men-in-black running (gowns twirling) from men-in-khaki (lathis twirling) was oddly familiar. The Madras High Court on Thursday resembled its Lahore counterpart, where pro-democracy lawyers took on the then president of Pakistan, Pervez Musharraf, over the suspension of the then Supreme Court chief justice. But the motives of the lawyers in Chennai were far less noble. A day earlier, a group of lawyers had attacked Janata Party President Subramanian Swamy in full view of two judges. They had objected to remarks against the LTTE, a terrorist group banned in India. Fearing their brethren's arrest, a much larger group of lawyers set fire to a police station in the court premises, attacked the police, smashed up court property, and injured a sitting judge of the high court.

The absurdity of lawyers jettisoning the reason, deliberation and calm that define their professional conduct is obvious. The arson committed by the Madras High Court lawyers - in any case, against the law - is all the more disquieting for taking place in court. The culprits must be dealt with in the strictest possible manner. Already, the Tamil Nadu lawyers' reputation for constant strikes has led even the Supreme Court to pass strong comments. But in this they are hardly unique. As the recent strike by the Delhi Bar Association on amendments to the criminal procedure code shows, lawyers all too often have scant regard for the disruptions they cause petitioners and litigants. By striking repeatedly and for little cause, they bring India's torturously slow legal system to a grinding halt.

The arson on the court premises dominated the Tamil Nadu state legislature on Thursday, with the opposition AIADMK demanding the DMK government's dismissal for the "failure of law and order". Thankfully, Chief Minister M. Karunanidhi has also deplored the incident, and accepted the demand for a CBI inquiry. But Tamil Nadu's politicians can't escape all blame. By keeping the Sri Lanka issue on the fast burner, and blurring the line between being pro-civilian and pro-LTTE lobbying, they have provided the context in which these lawyers have taken the law into their hands. It is hoped that the arsonists are dealt with sternly.

From the views expreesed by all of you, it appears that there are more than that meet the eyes. Firstly, not a single Tamilian MP from srilanka has resigned, Secondly there is not a whisper about GOI inaction to the tamilians suffering in Srilanka, Thirdly, the issue erupted in the Court when our lawyers brethern started throwing rotten eggs to S.swamy inside the Court, as if they always go to Court with rotten eggs in their pocket or inside their gowns. Its natural that I have all the sympathy for our advocates tribes, but the whole scenario apperas as if two innocent persons fight in the street for the fault of some other persons action.

MASSIVE HUMAN CHAIN AROUND THE HIGH COURT TODAY

Lawyers from Chennai today took out a massive human chain encircling the 36 acre high court campus symbolising how it was only the lawyer community which protected judges and the court campus targetted for vicious attack by the police on the 19th of February 2009. Though the call for the human chain demonstration was given only yesterday, the massive turnout for the belied the state's propoganda and the version of a pliant section of the media that lawyers had returned to courts in response to the call by the ruling party's legal wing.

The human chain followed on the heels of yesterday's rally to the Memorial Hall from the High Court campus. Again organised at short notice, hundreds of lawyers demonstrated that they stood united and would never be defeated.

Mr. M. Karunanidhi, the Chief Minister of Tamil Nadu, who has a history of issuing empty threats of having his M.Ps from Tamil Nadu resign from the Parliament, fasting from the hospital bed etc. has shown no sign of taking action against the errant police officers who have been indicted by even the much maligned (rightly, for the most part) Sri Krishna report. It is clear that he does not want to lose power at the centre and the state and that he needs a partisan police force to assist the party during the Lok Sabha polls.

But by taking no steps against the police, Mr. Karunanidhi is lending credence to the view that the attack on the lawyers and the police was a intelligence led "Operation Black Coat" operation unleashed by the State to stifle the voice of lawyers and judges and to enslave the state judiciary.

Whatever his motivation, it is clear that Mr. Karunanidhi has grossly underestimated the power of the lawyer community, and the carnage which he unleashed though the police has cemented various groups and forged a united front among the lawyers.

It is not as if lawyers resorted to direct non violent action alone. From the 19th of February 2009, lawyers have attempted to obtain legal redress for the constitutional crisis that has enveloped the state. The media and the "letters to the editor" writing public have hardly scratched the surface of lies to discover the truth, for it is prejudice and hatred that they prefer to truth and stuggle. So be it! History will judge us, not fickle media barons who depend on government largesse in the nature of assignment of land for their recreational sports venture, exoneration from cases and for reasons too varied to go into here in detail.

Now that lawyers have taken to the streets peacefully and to sensitise the general public about the threat to the body politic from a police force and a political class gone berserk and running amok, the sounds of the death knell being sounded for the present government are growing louder by the minute.
