Question on grandfather property

Hi Myself Surya,

My grandfather has a property in his name earned by himself, While he was alive there was an case against this property on Questioning LRF ordered by Court to him. He died in 1990 without any will After which the case was taken over by my father and brothers. The case finally was fruitful for us. Then the property was divided between three sons in 2000 by then I was a major. My father has gifted the small portion of property to my uncle name without my kowledge in 2003 by having faith that he will give the other portion of same widdth from his part to my father,  where a house is built currently. Now my uncle is not ready to give us the other portion and he claims he will not give an inch of land and also says that if the house is on your name claim from court and demolish the house. I asked him to sit and finalize but he is not ready to agree.

Now My question is Can i put a case stating that I have a share in my father property and was illeagally taken by my uncle without my signature. and cancel the gift deed.

What is the other solution to get the other portion from him or if file case will I loose.

Please help,

Regards,

Surya.
