In a deal for a property which is mortgaged, if the seller agrees to clear the mortgage on receipt of part payment, and it is entered in the agreement papers, but fails to clear the mortgage even after the agreed part payment, can he demand the balance payment and threaten to terminate agreement on non receipt of balance payment.
