I have taken a plot in a gated community near Nagole, Hyderabad in 2013. The builder/township chairman (AGPA holder of the land) provided the legal documents to me, which I got verified with a Lawyer. The Lawyer mentioned that the land is an assigned land but no issues as the High court judgement was in the favor of the land owner and the land is regularised and he said we can go ahead. I proceeded further and paid 27 lakhs (21 lakhs if from Housing loan) towards land and the house costruction from the bulider is not started yet. The HDFC bank also did legal veification and said title is clear and disbursed the loan amount and the plot is registered on my name.
The issue here is, recently the Builder/Township chairperson expired becoz of heart attack, after two days of his death I went to the venture and learned that the land owner is in delhi to attend the case in supreme court appled by Joint collcter (Govt) on the land owner on 2011.
We are not known of this case even we bought the land plot in 2013.
Please suggest how can proceed now, I do not want to loose the plot as this is the first and only property which i took.
If the judgement from supreme court comes in favor of Government, will I lose the ownership of the plot? Do all my spent on this will go vain? In that case should i still continue paying the EMI to bank, I understanding is it's bank reponsibilty to do throigh check of the title and then release the loan amount, and hence i beleve thr bank should take the responsibility here.
