Shashi Dhara. please explainn your answer ( You do one thing, if purchaser does not object,yourself register it as the flat is old,they may agree. The flat is old.A release deed on a stamp paper signed by the brother sister and Notarized, is it ok. An Affidavit cum NOC from the heirs, signed and Notarized, is it ok.Please let me know. If I have to do registration, how much it will cost.

1. why was I charged 29,000 rs.stamp duty. It was free gift. 2.Is release deed and relinquishment deed same.what are charges for them in Maharashtra.
3.Is limitation act applicable,as my mother after getting the flat in her name as a nominee,she waited for 20 years before giving the gift deed.Do the heirs have a claim as per limitation act after 20 years,as by the act the heirs cannot claim after 12 years.So the flat goes to the mother.

Dear sir, in the year 2007, the stamp duty for Gift deeds shall be payable at Rs.5% on the value adopted by the party or Market Value as Govt. Registere whichever is higher. 

But all the heirs of your parents have equal rights over the property.

Thank you for your advice.You are saying the heirs have equal rights even after 32 years, although they have not made any claim or objection so far.ok.I will make a release deed and signed by the registrar. If I do a release deed and An Affidavit cum N O C on Rs.200 stamp paper and duly Notarized will it be acceptable.???

PLEASE CLARIFY WHAT I HAVE TO MAKE RELINQUISHMENT DEED OR RELEASE DEED FROM THE HEIRS OR ARE THEY BOTH SAME.WHICH IS BETTER.

Notarised affidavit not valid.  it should be executed by your siblings in your favour.  then only it will be legal.
