Property rights of persons who left India

sir i want to know what will be the status of the right of person who left India long time ago and he is a muslim and is no more a resident of India now.. What kind of rights does he possess now on his property....

What are the documents with him to prove the ownership of the property and what is the current status of the property.

If as per government records or society records any property is his / her name or he /she is  owner of any property in India that means this is his / her property and he / she is absolute owner of the property kindly he / she check government records.

as per muslim law you could not claim like hindu law, if muslim father either give gift, or will then only get the shares in father property.

If his name is still appearing in the Government Records as owner, he has every right over the proeprty and if he left India during partition in 1947, it might have been acquired by the Govt. and might have declared as evaque proeprty in that case he cannot be deemed the owner.

If you have entries in records of rights then you will be the owner of the property except in case of evacuee property as explained by Adv Sachin Agarwal.  Please follow up with the local lawyers expert in property matter.  All local laws and law of limitations are applicable for claim of property.
