I am the secretary of a Co-operative society. In 2001 a member on a society who had a open terrace in his flat handed over the open terrace to the society as he could not afford the terrace repair charges on his open terrace. The flat below his terrace had immense leakage. It was decided in the AGM of the society that if that member could not afford he would surrender the said open terrace and the society would repair the terrace and open it for all the members for use. Based on such discussion and exchange of letters the members sent a letter in which he mentioned that he cannot afford the repair charges and said that the society can break the wall on his terrace. Since then the society has been paying the tax for that property have repaired the terrace twice. Now after the death of the original member, since the society is going for redevelopment, his sons want the terrace back and are creating issues in all the meetings. What can be done. All the documents were shared in the recently concluded AGM.
