Proof of service via email in a writ petition

Should Proof of Service via email be attached before or after the writ petition? Should it be attached as an annexure? What should be content of Proof of Service to the Respondent? Can one just attach screenshot of email as proof of service?

The proof of service should be attached to the writ petition as an annexure.

It is a supporting document that provides evidence that the respondent was properly notified of the legal action.

Many courts require the proof of service to be submitted along with an affidavit of service. This affidavit, sworn by the filing party or their counsel, certifies that the email was sent successfully and that the provided email address belongs to the concerned party.

A simple screenshot of the sent email is generally considered insufficient and unreliable proof of service on its own.

While courts have accepted electronic evidence, it must be properly authenticated to prevent concerns about manipulation or tampering.
