Possession letter dispute

Hello,

I have purchased a flat in Pune in 2010. Agreement was done on my name in May 2010 and possession was taken in June 2010. However due to VAT dispute, builder did not issue possession letter to many flat owners. Now the project has been handed over to the society and we have society share certificate. When asked to builder about possession letter, he asked to pay VAT first to get the it. As per VAT law, builder is liable to pay the VAT.

I am looking forward to sell the flat but getting worried about possession letter. Please guide me about the legal difficulties I may face. Shall I pay the VAT and get the possession letter from builder? How important it that letter?
