Well though consumation is neccessary for marriage in hindu law and if consumation doesnt take place in marriage then it can amount to cruelty which is one of the ground in of divorce as per section 13 (1) a of the Hindu Marriage Act 1955 however there has to be another  ground like that after solemnisation of marriage other party had s*xual intercourse with any person other than his or her spouse . please refer section 13 for more information .
Well it is neccessary to aply for annulment of marriage before 1 year of marriage .
