Respective Sir,

I am working in pvt. Ltd Company from last 5 years, (Gov. & Pvt Tender)

Company has taken lone from bank same like Niraj Modi.

Due to some management issue with client, Some Tender has been terminated by client in middle half working.

Due to some financial and banking situation fund was block by client.

  1. PF not paid from July 2016 (PF notices received so many time)
  2. ESIC paid up to sept 2017 (ESIC notices received so many time)
  3. From last two year Leave and benefits not given by company.
  4. Salary not regular from last 8 month, now 4 month salary pending to give us from company.

As company has received more than 50 % fund in six month.

But company open new current account for receiving/coming fund. Without knowing to other bank.

Some staff asks to pay PF & ESIC for emergency as earlier but Management / Director is not ready to pay. Whereas director saying we can’t pay all this right now due to behaviour of management, many staff left job, Management fix answer to all company has so many lone, and all vender pay-outs balance we not going anywhere.  Whenever company received all fund we think on it.

Many venders and consultant file a case on company.

As per your needs and your advocates advise you can appraoch NCLT under Bankruptcy Law or under Industrial Disputes Act or ESIC or PF or labour commissioner for your reliefs against the company
