My CHS committee members have decided to ban flower pots in the balcony area on grounds that it spoils the paint of the building. They have gone on to impose a fine of Rs.300 per day for keeping these plants. Neither the fine nor the banning of the flower pots has been approved by any general body meeting.
They are sending me notices of Rs300 fines everyday saying that Managing Committee's decision is final.
1. Does the managing committee have the authority to ban us from keeping plants if we have ensured that there is no water spoiling the paint of the building from our plants?
2. Does the managing committee have the authority to impose such a huge fine(Rs 300 per day) without giving us any chance to explain our stand on the same?
3. We have written to the managing committee on the same issues but they have not given us a satisfactory answer yet. We are willing to fight it out in court to save our plants what should we be doing in this case?
