Peding sallary

Dear Sir, I, Rajeev Ranjan, Worked in Tops security Ltd, Delhi from march 2012 to Oct 2016 as a Member of security guard. Due to May’16 recession problem, the company was unable to pay the salary to his entire employer on august 2016. Even company management called different meeting and given the assurance that they will pay the pending salary gradually, but there was no progress from company side. Due to continuation of this issue most of employee resigned from the company . with proper process without getting the pending salary. I have 4 months’ Salary pending with company; even company has not paid our PF . also. when I asked about my pending amount; they are not ready to give me any satisfaction date or time Please kindly anyone suggest me what I should do to take any legal action against on company. Is there any law protecting employee's benefit? Even If I get some good suggestion then we are planning to put some case against the company. Your prompt response shall be appreciated. Thanks & regards Rajeev ranjan Vk810611@gmail.com

Your counsels may ask you a set of structured questions and may opine that you shall be covered by the def. of 'Employee' as in (Name of your state) Shops and Commercial establishments Act, 'Workman' as in ID Act, and opine that you can raise a dispute NOW also and approach:

---Inspector appointed under :

Delhi Shops and Commercial establishments Act,

Payment of Wages Act (within 1year),

enactment for security personnel……….

---O/O Labor Commissioner

---Higher Officials of Dept. of Labor in your state

---Civil Court

---Employee's/Trade Unions

---file complaint u/s406,420

--file for winding up petition as unpaid wages/promised payouts are debt on employer……………………………………..and there is not limitation on claim of payment of wages by workman.

Your counsels can draft your representations.
