Payment of Wages Act, 1936

1. Where remedy lies to a case duly admitted by the labour court, despite the salary claim being in excess of statutory limit permissible under P.O.W.A.1936 (Amnd.2005).
2. What is the limit of (wages) claim under the P.O.W.A.1936 (Amnd.2005).
3.Is the offense compoundable ? if yes, then with or without permission of court ?
4. Is the demand by the defense counsel for Income Tax Return can be denied on the ground that it being a privillaged document ? (basic purpose of defense being to expose the intent of the prosecution, that prosecution party has never shown such amount in his Income Tax Return in which he has filed a claim for Wages of Rs.7500 per month?
5. Does the labour court has jurisdiction to try such case ? (wages claimed Rs. 7500 per month)

yes you can file a application before the labour court and take objection about the selling limit jurisdiction.


it is rs 6500


offence is not compundable
