Partition of ancestral property.

Respected sir,

We have an ancestral property (Corner Plot on state highway)of my Great Grand father,which was partitioned earlier by himself (G.Grandpa) to his two sons equally.

At present he himself and his two sons are not alive. Now his grand sons wants to claim their part on behalf of their father w.r.t the above partition deed.

This deed was finalized around 45 years back from till date.The sons of great grand father partitioned their part verbally and its descripttion synopsis (front side is for the elder son and the rear is awarded to the other son)is mentioned in a Diary duly signed by the witnesses at that time.

None of them including the witnesses are not alive today.

Thus that diary bear any relevance at this point of time for the partition of that ancestral property of my great grand father.

Now the question arises who will take the front and rear side of the plot !!!!!!

If the partition arrangement was registered earlier, it has some value, if not it is just a piece of paper.

This being ancestral property and have been partitioned orally among the to sons then, both of them have occupied their respective share of property and have been living without any interruption till their date, the property after their demise will automatically devolve on their respective legal heirs in the descendancy.
