Is it legal for an employee of a Company A to work for Company B, without serving resignation to Company A? What are the consequences regarding PF/Gratuity/Income-Tax/Corporate Policies over working in two companies in parallel and operating a proprietary firm ?

In the contract of employment/appointment letter usually it is stated that employee can not be engaged in gainful employment elsewhere.
If it is mentioned the employee in question has violated the terms of contract of employment.
