Exparte decree of permanent injunction summon served respondent appeared through counsel but not contested the suit. whether the respondent can file set aside petition under order 9 rule 13 cpc on the ground of jaundice?

Yes ,ex-parte decree can be set aside by the court on the sufficient ground.. Illness is sufficient ground due to the reason applicant could not present in court.
