Notice period buyout

Hi All,


I am working a Software Company in Noida. I want to leave this job and my notice period is 3 Months. I serve it for a month and planned to buy 2 months notice period. As per my knowlegde, it should be Basic Salary + DA but my company is taking on gross salary (i.e including HRA , LTA).

I want to know, Is it legal to include HRA also. If not, can you please help on this issue. Can I legally get rid of paying HRA.

It is not gross Salary but as you said basic + Da not HRA and other benefits. If your employee persists in this - serve him a legal notice.
