Not to compound u/s 406 of ipc

Chairman has filed complaint on behalf of the society u/s 406 of IPC against accused. Exam-in-chief is already started in the trial court. Now, the newly elected managing committee of the society want to compound the offence and the original Ex-Chairman want to. continue.

Can you provide the Supreme Court citation in support of ex-Chairman, who don't want to compound the offence and want to continue with the proceedings?

It is not the new chairman or the ex-chairman but the Code of Criminal Procedure Code (Amendment) Act of 2008 has made that section 406 of the Indian Penal Code as non compundable offence.
