Non taxability of exgratia

Arunbhai R. Naik Vs. Income-tax Officer - Court Judgment  

sir according to my understanding after stuyding the judgment there is not applicablity of tax on exgratia

i think if we file appeal we can get advantage of this case because court/tribunal sometimes deliver judgement whics h become trendsetter.please reply can u help me as this is a matter of 7.5 lacs
