Need judgement Foreign citizen bil implicated falsely

I have tried looking for judgements 1. Is dv act applicable on a relative who is a citizen of another country. Is it limited to indian citizens 2.my brother a foreign citizen who never met us post marriage has been fallsely implicated by my in dv by mentioing that he is a resident on india and given my mothers address in india.at the same tine they aay he is working overseas but the fact is that he is a citizen overseas and not working. If anyone can provide aone judgements to get the case dismissed
