Need advice

Hi, My name is Bajrang Singh, I was worked in a bpo at Barmer Rajasthan. 24 Jan. I applied for leaves 13 Feb to 25th Feb.for my brothers marriage but my manager didn't reply on my mail.he unmarked me on mail and send it to higher level.when I come to ofc on 25 Feb. They abscond me due to unplanned leaves.They put My salary on hold. And mark black spot on my carrier " absconded. Please suggest what should I do.

As per various threads BPO/IT/ITeS managers/establishments are knwon to react like this and be insensitive.

Since you are in this sector familiarize yourself.

If you have applied on 24th Jan for leave from 13 feb-25 Feb, then it is not unplanned leave.

If your manager has not replied on approval/declinature then it is your manager that has also committed a lapse.

Although it is true that until approved you should have not proceeded on leave.

However the manager should have communicated declinature if not approval.

Since you had applied for leave you have not absconded.

BPO's are covered by Shops & Estbs Act, so you may go thru Rajasthan Shops & Estbs Act, Rajasthan Shops & Estbs Rules and various registers/froms prescribed under rules, and relate these with Leave Rules of the company.

The leave rules can provide superior benefits but not inferior benefits, than the rules/Acts.

You msut get the tag of 'Absconder' (that is also derogatory) removed from your personal file/registers-froms prescribed under Rajasthan Shops & Estbs Rules/service card, get your leave regularized, and rejoin before you decide to leave again with relieving letter with good comments (avoid without comments/adverse comments). 

There are BPO employees/Employe's/Trade Unions and its leaders that can help you or you may approach:

an able Labor Law Consultant

and under expert guidenace of your counsel approach;

Inspector appointed under Rajasthan Shops & Estbs Act

O/o Labor commissioner

 

 Unions in Rajasthan have traditionally been strong.

 

If BPO's are not exempted in Rajasthan from standing orderes then you may also relate with standing orders (model/Certified).
