My nephew claiming the property of my mother as a tannent.

Dear sir, My nephew (son of my elder sister) was staying in our house from childhood and got her qualification from our house. Presently he is maintaining a office at our hose for his business. He has a trade licence on the basis of his Voter Card, Pan Card etc.,ther is no Tannency Agreeement with my mother. Address of his Voter Card, Pan Card, etc. and Trade Licence are of our house address. The owner of the house was my mother, who died three years back. Since our house is 60 years old, we (two brothers for sisters and father also) had decided to handover the house to a Promoter for Development. Now our question is wheather our Nephew can legaly claim for Office Space in the New Construction? If the answer is YES, then our second question is, wheather Office Space must be provided to him in the same place of the new construction, as it is now in the Old House.
