Mvat - giving money to promoters even after possession

AS per recent MVAT (VAT on Flat Units Sold out in Maharashtra),  even if  I have came into agreement during sale with the builder following one : “The purchaser shall also separately pay and bear and/or keep deposited with the promoter/builder any amount towards sales tax, works contract act, VAT, Service Tax or towards any such duty and/or levy and/or charges as may be levied by the Government and/or local authority. The purchaser has/have satisfied himself/herself/themselves about the expenses and he/she/they shall not ask for any separate avccount of the same” 

Now Builder is asking the VAT from me around 3 Lac rupees. Builder has already given possession and society is already formed one year before. Can  he execute this processings against me?

I feel as per the law I am ready to pay the amount to the Govt seperately whenever Govt will levy it to me.

I want to know whether I should pay it or not..
