Me and my brother are tenants and occupants of two adjacent rooms since 1999 in a South Mumbai building and have seperate entrances, rent receipts, electricity bills,ration cards and voting cards. Now the building is going for redevelopment and builder is giving one joint flat in new building stating that MHADA has clubbed these two rooms.
We want seperate flats and builder says he will go by MHADA. Now why has MHADA clubbed the rooms and principally speaking , how can MHADA and builder enforce joint rights over property when we are seperate sole holders in tenanted building?
