ya perhaps for this reason acquittal is much higher in this type of case.

But when one complains against a man for adultery it means he himself has seen that man doing intercourse with a married woman. then he himself is a eyewitness. And can give oral evidence.

Truly said Saurabh!

When we study this section. It shows a wife is a property of his husband and the wrongdoer (Adultering man) is committing crime resembling as against his property.

the section itself says in the end.......

 

Section 497. Adultery

Whoever has s*xual intercourse with a person who is and whom he knows or has reason to believe to be the wife of another man, without the consent or connivance of that man, such s*xual intercourse not amounting to the offence of rap, is guilty of the offence of adultery, and shall be punished with imprisonment of either descripttttion for a term which may extend to five years, or with fine, or with both. In such case the wife shall not  be punishable as an abettor.

nothing incriminating when one intercourse with a unmarried lady!!!!!!!!
