Minutes of meeting of co op hsg society

The newly registered co op hsg soc in mumbai held First General Body Meeting and Secretary circulated draft MOM just 3 days before expiring of 3 months limit. Some of the Members have jointly given in writings thier objections to certain resolutions wrongly mentioned and adopted in Draft MOM within time limit of 15 days of receipt of Draft MOM.

The Secretary refuses show or to give final Corrected (or not) MOM to the Members either soft or hard copy and asking payment for Hard copy under pretext of Bylaws,when he had already circulated hard copy of Draft MOM without asking for payment.

The MOM was never read out, ratified or confirmed in subsequent SGMs under the pretext that this is not required for First General Body Meeting as per by laws.

Is Secretary attitude is correct not to give and or circulate Final MOM and under which clauses of By laws or MCS Act.

Under the above situation what actions are required to be initiated against Secretary.

You can send a legal notice to the secretary pointing out the violation of bylaws in this regard and demand the desired relief.

MoM needs to be approved by the GB.

You can report about the Secretary to the Dy.Registrar of Coop. Housing Societies of your district. And no action by the Dy. Registrar, you can proceed legally.
